TorrentSpy Acts to Protect Privacy

Torrentspy.com, an International search engine that provides links to torrent files, has decided to stop accepting visitors from the United States.

Torrentspy's servers are located in the Netherlands and is subject to International privacy laws including those in the European Union.

Torrentspy.com has a strong privacy policy protecting site users against the linking of personal identifying information to searches absent user consent.

Torrentspy's decision to stop accepting US visitors was NOT compelled by any Court rather it arises out of an uncertain legal climate in the United States regarding user privacy and the apparent tension between US and European Union Internet privacy laws.

I am trying to figure this one out. TorrentSpy located outside USA jurisdiction, decides that because the USA doesn't have good privacy protection laws, that no one from the country should be able to use TorrentSpy, which is located in a country that DOES have good privacy protecting laws, and is operated under such laws. I think the claims are a little backwards in logic. Logically, since the site is under the jurisdiction of the good privacy laws, we should WANT everyone to use it as such. It isn't as though the site was in the USA, and because of the privacy laws (or lack there-of) decides to move out of the country to a place that has better laws.

In case and fact, the United Nations, International Law, and the World Trade Organization has sided again and again that the rule of law where the site is actually located is the rule of law for the site. Which is why the USA is currently being brought before the World Trade Orgainzation for damages by Antigua for the USA law against online gambling.

As a Canadian, I feel for you guys, but am also happy for the continued usage of torrentspy even at my southerly neighbors' expense. And really, I know it's not your faults individually, but it's almost entirely America that is causing all the worldwide pressure to stop bit torrent.

The WTO case with Antigua is not over privacy laws or even really laws of another country. It's a bit bigger than that. The US bans online gambling from all sites except certain vegas sites which are allowed to take/make bets, and the literature of a US law that implies that one can make horse racing bets outside the race track. This means that Nevada has a gambling monopoly over US players, and thus Antigua cannot compete because it's banned to by US law. Thus the WTO has found it to be an unfair trading practice. The ONLY place US players can choose to play poker is via Nevada (or Atlantic City, etc) places that offer poker/gambling. It would be like France banning the sales of Advil except if bought from a certain area that makes their own Advil-- Now no country can sell their Advil-like product to French people, because one area in France has a monopoly on it in the country. That is considered a WTO unfair trading practice violation. The only way around that rule is if the US were to ban gambling everywhere in the US, thus there is no market and thus no rules are broken.

I think torrentspy might be afraid of what the US might do to our ISP's should the court cases fail. They're probably doing us a bit of a favor, or at least I'm paranoid enough at this point to think that the MPAA has the FBI or someone suing ISP's to see (somehow) what I'm searching and, of course, what files I'm downloading from here.

But it will bite them in the ass because, as nick and gunitstoner said, there are so many US products being pirated, so many US users who contribute to this site (I mean we are a big ass country) that you'll see a lot less torrents around I bet. But then again I could be wrong.

I love TorrentSpy, so I was rather upset when I discovered the search engine was no longer open to American users. However, I do understand and appreciate that TS is protecting the privacy of its American users instead of simply giving in and sharing user information. Thanks for that. While I'll miss using the site, I really hope you all get this nasty lawsuit business sorted out.

It's funny to see some people complaining about the site when everything is being done to avoid abusive American legislation intrusion.

If you don't like it, how about complain with your legislators for such absurd laws, with your government for thinking USA laws rules the entire universe, with your ISPs which are providing user data without court order, with the telecom companies that gave them an office to spy on users calls and data?

The Torrentspy server are run by individuals, which can't face a great organization like MPAA without a big effort. And what about the world users, even the Americans, whose identities can be found through the IPs found in server logs? Will you trust in the American government your data? I won't!

1) TorrentSpy has US servers. Had, now. So they weren't exactly outside USA jurisdiction.
2) The judge already threw out the not-US-based argument. TorrentSpy could've refused to comply, but then the US users would've been screwed anyway.

this is indeed an annoying move by torrent spy, however, while American's can mostly* not search through the database anymore, why are there materials still being shared? if you can chose to see the American IP's and disallow them, will you do it for downloads!? or just searches. I take this move as a piece of regionalism prejudice for one country, what of the others that are following the trains of thought on the legality of file sharing!

I'm sure that Torrentspy's advertisers will not be too happy with this decision, it wouldn't surprise me if they pulled from TS to advertise at torrent sites that DO accept American users. I can still access my account and use TS as I always have inside the USA - there's always a way ;) - but I rarely use TS anymore because there are a few other sites which don't track as many DEAD torrents. I imagine it won't be long before TS is begging American users to come back, but we'll have finished migrating over to mininova, demonoid, etc... Sorry, TS - but you will be reconsidering this mistake before long.

One of things that annoys me most about this country is how we allow attorneys to run almost every aspect of our lives. Doctors are afraid to to research new methods of surgery, potential life saving medicines cost over a billion dollars to bring to market due to the legal hoops they must jump through. Common sense decisions like seeing bittorrents for what they are are filtered through the verbage of attorney-speak and comnes out as the most evil sounding thing to ever happen to humanity. Judges end up pressured to make ill-informed decisions which only protect the "chosen people" who run the media empires of movies and music. You really have to sit back and wonder how this will all play out eventually.

What annoys me most is that my fellow Americans are ignorant of what is going on. Complaining and complaining on how we are blocked from using the site, which has "American" files and such. I for one understand and support their decision. Our gov't is allowing the MPAA and RIAA to bullying us and the sites we use to pay up. We've become a new type of customer, the free money type.

I'm not clear on how torrents work, but I'm sure just because we don't have direct access to this site, doesn't mean we can't get the file. How many torrents do you get from here that has a file from Demonoid? TorrentSpy just points us to a seeder they know of. So what, we've lost one search engine to our gov't, we've still got plenty more.

We Americans need to stop complaining when we lose one of our services, and start fighting to get our services back.

And another thing, you idiots who are commenting on how stupid it was for this "lousy" search engine was to stop allowing Americans in, do us all a favor and shut up. If it's so "lousy", then why are you complaining?

It seems to me as an american who uses the site that if we want to send a message to these people once and for all - we need to take a much more economic stand. People in the US are all too willing to sit around and complain about this kind if treatment from our court system - instead of actually doing something about it. We live here and we drive the laws in part when we stand as one and take a collective stand against this type of censorship.

If the MPAA wants to ban our rights to trade and share files as we should have the right to do... then we need to ban their products and send them a message we are not going to spend our money on any of their entertainment until they realize we will always want to share files and there will always be another method or another site that pops up and takes the place of the fallen.

It really makes me mad when we see a great site or tool online that is crushed because some rich corporate a**wipe wants even more money for ad sales.

If you really want to send a message and help protect our rights to free content and privacy online. Then we need to stop going to the movies (at $9.50 a pop for a ticket that is not all too hard to do anyway) and stop buying DVDs and stop Renting movies, and stop watching Motion Pictures altogether.

We are working here in my state to organize boycotts and pickets at local theaters, courthouses, and even the state capital.

If this type of public protest occured to get the attention of the media and get the public out in front and make a statement and send a message... if an artist tries to back a studio ban their films, if the next big blockbuster from the studio only makes a few hundred thousand on opening weekend instead of the few million - they will notice.

Realize also - the MPAA is coming off its best summer at the box office EVER - almost 4+ billion dollars this summer... so they have fat pockets thanks to us complainers.. we have paid for their court case.

I for one... will be out making as much noise and posting on as many sites and blogs as I can - till I stir up what I can ... in the end we have to start to take back control of the US government from big brother... or we will all be paying out the a** for it.

Sorry guys, but I really think that not directly, but this problem was caused by you Americans! U allow the company to take as much power as they want so, for an European point of view, sometimes it's better to leave the market than having all this juridical troubles.
Of course TorrentSpy knows that the most part of the people that is able to download a torrent is also able to connect to a proxy server, but in this case it just avoids to itself all the troubles.

all the newspaper said that this can be probably saw as a victory from RIAA, but actually i think that u should be really in worry, because now you all know that u leave in one of the most rich and developed country, but your privacy is not respected by the law. I think that u should complain more, and maybe when there will be the election remember this episodes, because if u continue in this way, u wont really have a privacy. think about this law applied with sites like google, yahoo or AOL.

We can't expect TorretnSpy to face down US courts. So I get it. They're doing what they have to do. It happens when you're backed into a corner. And frankly, they're protecting their users with this withdrawal.

Think about it people, they cut their search bandwidth down by a quarter (I'm being generous, I bet it's closer to half;) get awesome, "we gave the US the finger" street-cred; AND still keep all the annoying and invasive ads. These people aren't dumb, they're savvy fucking business men who know exactly what they're doing. Have fun with your illusory sense of privacy while the site maintainers line their pockets.

I think you are right... I think that the most part of us (European) don't really like much the USA (specially its politics).
But this is not the point: TS and all the other companies don't care about love and hate when they can gain money. do you think that they wouldn't keep the US market, one of the biggest, open? Of course they would, but probably they care more about the privacy of their users than the money, they are probably, as Bill Gates define them, the new century communists.

This is a search engine just like Google. Its not their fault how post what here. Maybe they can reach a middle ground and start removing all copyrighted stuff from here. But even then its a huge list to go thru.

Or Torrentspy should become a regular search engine, have it so u can leave comments on websites u visit. If a torrent link happens to come up in their engine, hey....if someone decided to leave a comment on it, hey....Plus Google is about as good a torrent search engine as any ppl use. In fact someone made a torrent search engine based on Google results. When are the RIAA n MPAA gonna go after Google then?!?! U can even use Google to find backdoors in supposedly secure sites.

Anyone who can use a search engine should look up "MPAA lawsuit". You will find NOTHING! The actual lawsuit is by individuals and NOT by any entity such as a federal spy group. The ban is a fraud and the operator of Torrent has gleaned a lot of money from unsuspecting people to "support" the cause. Dont look at this all one-sided. Look at it from a wide angle. Copyright laws are different in different countries. Maybe the RIAA and MPAA got more power in the US than anywhere else. That could be the reason for banning us IP addresses.

I still cant for the life of me understand why ppl are bitching when they are doing this in the best interest of U.S. folks. Who knows, maybe they win the appeal and U.S. folks will be allowed to use the site again.

I just read that TorrentBox is blocking U.S addresses too. They are doing it differently than TS tho. Thats 3 sites thats blocking specific addresses. I wonder whose next?

And I kinda agree with nekona about putting up a warning and leaving the site open to all users. If ppl wanna risk lawsuits, let em. Hell, some of us are risking lawsuits already just by using torrents for copyrighted stuff. It wont be TS fault. TS should do that now just to see what happens.

TorrentSpy used to be my favorite torrent site, but is rubbish now for 3 reasons...

1) No access to US addresses without going through a proxy.

2) Too many ads so I've been told. Adblock + Greasemonkey FTW.

3) I decided to stop on via a proxy just to try some searches... funny, I did a search episodes of the current running season of Heroes and House M.D. and they all came up empty, though searches for previous seasons showed just fine. Thus, apparently, TorrentSpy is now so weak they're filtering their own torrents! Sad sad end for a good site with a nice interface. I'm hanging at Demonoid, Pirate Bay, TorrentReactor, and others from now on. Sites which still have balls.

I wonder why more people in the world can't understand that just because you own something doesn't mean that someone can't just take it from you. You really should take a trip across the pond to straighten out the RIAA and make them understand that they should just give away their property for free. Perhaps if you have time afterwards you can fix the Constitution and remove that bit about property rights.

We would do something about it but we're too busy getting fat on Freedom Fries and listening to the word "terrorist" being repeated over and over on the evening news.

If ads are not shortened I'm sure most of the users will not visit this site anymore either way. BTW you are not going to increase your profit by spaming the site with ads, you rather need to highlight and more more interesting ads to do so.

I agree with the fact that torrentspy is doing America a favor by protecting them.

However, if they really cared, they would just block American IPs from the entire site. Not just the torrent index. So, they are still looking after themselves, as there are Americans oblivious to the fact that TS's torrent index is inaccessible to them, yet they are still viewing the ads.

Just my 2 cents. If you are going to block us, don't do it half ass, just give us a white html page with a large error message.
